Abstract: | 兩岸關係隨著科技進步、經貿發展、互賴程度加深,讓資訊流通更加快速,電腦、手機幾乎成為人類生活不可或缺的一部份,這一方面這為人類社會帶來便捷,但也因為資訊產品的普遍性、便利性、快速性以及隱匿性等特徵,而有越來越多不法之徒利用科技作為犯罪的途徑,海峽兩岸的詐欺犯罪猖獗便是一例。本研究運用質性的歷史研究法,透過詐欺犯罪相關的歷史資料,包含官方次級資料以及報紙等文件,依事件發展的過程進行分析與研究。另外搭配訪談法,以彌補一些文獻上較缺乏關注的議題或論述,同時增加本研究的實證性。本文的研究架構,首先提出研究動機與目的,希冀探討台灣詐欺犯遣返問題的政治或經濟因素,以及提出兩岸詐欺犯罪的產生是否攸關經濟條件背景抑或其他因素?兩岸處理詐欺犯罪做法的殊異及影響,皆為本論文的問題意識。本文的研究發現為:詐欺犯遣返涉及了政治因素,根據筆者訪談警察與調查官,以及統計資料顯示,馬前總統時期兩岸共打詐欺犯罪機制頻繁,詐欺犯遣送回台者多,蔡en-US總統執政至今,兩岸關係冷卻,兩岸共打詐欺的機制停擺,詐欺犯的遣返涉及了兩岸關係不明朗的政治因素;詐欺犯罪的產生攸關經濟因素,在台灣經濟現況不優勢的情況下,中國大陸崛起後,人民幣影響力提升,許多台灣人從事詐欺犯罪而不願依靠勞力賺取金錢,全球化下的經貿流通也加速了犯罪者渠道的流通;兩岸採用傳統結合科技的偵查方式,雖然網際網路有助於警方進行犯罪來源的偵查,但是資訊不足時,要查獲集團仍有很多困難;目前蔡en-US總統執政後的兩岸關係黯淡,少了共打犯罪的機會,此為目前打擊詐欺犯罪的弊病的部分;由於兩岸合作打擊詐欺與人員遣返的機制不再運作,所以當台灣的犯罪人被遣送至中國大陸並判刑後,也給予台灣觀察中國大陸刑法判決之方式;本研究建議兩岸談判合作的建立;建立兩岸刑事司法互助實質關係;刑度加強並分等級;從小教育; 強化跨國司法合作機制。 Cross-Strait relations, with the advancement of science and technology, economic and trade development, and deepening of interdependence, make information flow faster, and computers and mobile phones have become almost indispensable parts of human life. This brings convenience to human society, but also because The universality, convenience, rapidity, and concealment of information products, and the increasing use of technology by criminals as a means of crime, is a case of fraud on both sides of the Taiwan Strait.This study uses qualitative historical research methods to analyze and research the process of incident development through the historical data relating to fraud crimes, including official secondary data and newspapers and other documents. In addition, the interview method was used to make up for some issues or discourses that were relatively lacking in the literature, and to increase the validity of this study.The research framework of this paper first proposes the motivation and purpose of the study, and hopes to discuss the political or economic factors of the issue of repatriation of swindlers in Taiwan, and whether the emergence of cross-Strait fraud crimes is related to economic conditions or other factors. The differences and impacts of cross-strait fraud handling practices are all based on this issue.The research in this paper finds that the repatriation of fraudsters involves political factors. According to the interview with police and inquisitors, the statistics show that former President Ma has frequently used swindling guilty crimes on both sides of the Taiwan Strait. There are many fraudsters sent back to Taiwan. Since the beginning of the year of President Tsai Ing-wen, cross-strait relations have cooled, and the mechanism for cross-strait fraud has been suspended. The repatriation of fraudsters involves the political factors of unclear cross-strait relations; fraudulent crimes are related to economic factors. Under the circumstances that Taiwan’s economy is not superior, mainland China After the rise, the influence of the renminbi has risen. Many Taiwanese have engaged in fraudulent crimes rather than relying on labor to earn money. The economic and trade circulation under globalization has also accelerated the circulation of criminals' channels; the two sides have adopted the traditional combination of scientific and technological methods of investigation, although the Internet The road helps the police investigate the source of the crime. However, when there is insufficient information, it is still difficult to ascertain the group. At present, the relationship between the two sides of the Taiwan Strait after President Tsai Ing-wen is bleak, and there is less opportunity for crimes. This is the current crime against fraud.
