Abstract: | 本篇論文因對小林村維護傳統文化的感動,進而探討公共藝術的領域。爾後在《公共藝術設置辦法》條文修正的探討中,發現「民眾參與」自審議結構中移除,因此產生「公共性」是否有所變化的疑惑。研究方式以文獻探討為主,輔以專家觀點,除了得知國內專家學者對於公共性的觀點如何、體制上是否認同、未來觀點有無一致性,還增加了台灣公共藝術現行公共性狀況資料的搜集,得以在《公共藝術設置辦法》的條文修正施行兩年中,從台灣發生的現況與學術的理想間找出問題或差距,期能增加政策制定者做政策裁量的讀取資訊,並幫助後續的研究者尋求平衡之路。在研究各國公共藝術歷史演進過程中,發現公共藝術也因民主制度的日趨落實、公共性的有效實踐,得以和民眾結合共同解決社區或生活問題,小自社區廢棄水泥電箱的再利用,大至種族歧視傷痛的跨越,民眾因貼近或實際操作公共藝術的知識與經驗,開始了解自我的需求並發聲,良性循環下的效益,除了增加生活美學的經驗,民主自覺、尊重他人的效益也與焉產生。論文中以體制面、公共性、未來展望三大層次做一綜合分析,得知《公共藝術設置辦法》修正後,我國公共藝術與公共性的關係如下:(一)體制面:1. 民眾參與深度與公共性標準的分歧。2. 民眾於審議結構中的消失,造成公共性的傷害。(二)公共性:1. 民眾參與初期審議具有法令上的合理性。2. 公共性理想與施行現狀的落差。(三)未來展望:1. 國家政策的平台建構。2. 多元型式的轉變與滿足。基於「人民之自由非國家無以為之」的事實下,筆者提出以下建議,第一、在考量民眾參與非專業的限制條件下,應參照英美法體系中著重於行政行為實施前的告知、聽證等事前程序的精神,作為提高執行前計畫訂定程序密度的方法,長期實施之下非但能以公共藝術增加美學經驗,也助於民眾累積民主之經驗與涵養。第二、基於民眾非專業性之考量與疑慮,審議會中擁有專業知識者的角色應在於此過程中提供專業的建議,以便於民眾下判斷。在過程中透過民眾參與得以將抽象的「公共性」加以具體化,並於過程中使民眾能夠理解並認同此「公共性」的概念,使得公共藝術設置計畫取得其合理性,達到民眾參與審議委員中一席之意義。第三、系統式配套措施的補足。第四、增加多種類型的社會教育機制。公共藝術藉由民主產生實質的「公共性」與地區連結出的獨特文化進而深耕出成果,是處處可行可見的,也唯有具備深厚的文化,創意才能發揮豐沛的能量。由「文化」的沃土培植出「創意」的花朵進而結出「產業」的果實,每一階段如實的達成與連結,在其多元轉變的面貌中,國家因其而得到經利益的夢想才能得以實踐。在面對國家創意力量具有無限希望的同時,現實中民眾參與及理想間的落差銜接,以及「公共性」具體且實際的滿足,仍是此領域現階段努力的重要目標。關鍵詞:公共藝術、公共藝術設置辦法、公共性、民眾參與<br> This public art study was inspired by the Hsiaolin Village incident in which the villagers tried on their own to preserve the local traditions versus to remove the citizens’ right of participation from Public Art Regulation Revise and cause apprehension about public-ness. <br><br>The study is mainly based on the existing literature, and also experts’ comments, in order to have a thorough understanding of scholars’ viewpoints on public subjects, on system agreement, and future viewpoint agreement. In addition, also add the current trend of Public Arts in Taiwan and the differences between the academic ideal and the reality of our society. To help the policy makers better understanding to the problems and thus find the solution. <br><br>In the course of my research of the development of Public Art Exhibition in diverse countries, I also noticed that thanks to the sophistication of democracy, the public participation is practiced in quotidian life. From an abandoned electric box to the recovery of historical pain, through the practice of public arts, people have to come understand the needs of their own voices, which have created the consciousness of democracy and aesthetic appreciation. <br><br>In this thesis, we are looking at the subject in three aspects: system, public-ness and prospective. Comprehensively, after the revision of Public Art Exhibition Regulation Revision policy, the relationship between our public and public arts is as such: <br>1. System: A.) The depth of public participation and the differences between the public expectation and the policy. B.) The removal of public participation and the damage.<br>2. Public-ness: A.) Reasonable public participation at initial stage of policy making. B.) the discrepancy between the reality and the theory. <br>3. The prospect: An accessible policy making process. <br><br>Based on the concept that the practice of public arts is the basic civil right and the state is responsible for realizing such right, I suggest the following. <br><br>A. Considering that public participation is non-professional and open to everyone, we should encourage public hearing before the finalization of any public policy. Not only does it help to improve with the efficiency of policy making, it also help improve the understanding of democracy. <br>B. During the procedure of policy making, those who have the needed knowledge and experience should provide their professional advice to facilitate the decision-making. In this process, I hope to make the abstract idea of public participation more concrete so the public will understand the necessity of public arts better and to approach the significance of public participation . <br>C. We also need to build a system for policy complement .<br>D. Also as well as more diverse educational institutions. <br><br>Through the practice of democracy, the goal of public arts will be fulfilled by the necessary public participation. Only when we have strong and profound cultural connections, our creativities will be utilized effectively. <br><br>This country has unlimited creativity, however; at the same time, the difference between ideal and public practice, and also public satisfaction are all need to work harder at this stage of time.<br> <br>Key words: Public Art, Public Art Exhibition Regulation, Public-ness, Citizen Participation<br> |
